- Update 9/26/2021 The intent of this notice is for informational purposes only. This is an update to an original Special Notice SN-2020-20 posted on Beta.Sam.Gov on 9/12/2020.�The U.S. Department of Agriculture, Forest Service (USDA FS), Procurement and Property Services (PPS)�intends to award a modification to the existing sole source contract established with Fortress Fire Retardant Systems�for an additional�limited supply and ancillary product support of a Long-Term Fire Retardant�(LTFR) to the USDA FS�designated�locations, for the purpose of performing an Operation Field Evaluation on the interim qualified�LTFR product. The modification will extend the contract period of performance to 12/31/2022. The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(3)(2) (FAR 6.302-3) Full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources in order � to maintain properly balanced sources of supply for meeting the requirements of acquisition programs in the interest of industrial mobilization (when the quantity required is substantially larger than the quantity that must be awarded in order to meet the objectives of this authority, that portion not required to meet such objectives will be acquired by providing for full and open competition, as appropriate, under this part). The U.S. Department of Agriculture, Forest Service (USDA FS), Acquisition Management, Incident Support Branch (ISB) intends to award a sole source Indefinite-Delivery, Indefinite-Quantity contract to Fortress Fire Retardant Systems for a limited supply and ancillary product support of a Long-Term Fire Retardant (LTFR) to the USDA FS designated locations, for the purpose of performing an Operation Field Evaluation on the interim qualified LTFR product. The USDA FS is continually reviewing, testing and sourcing new LTFR products and suppliers to increase capable sources of supply, to continue to meet greater wildland fire demands and continue to exceed changing environmental regulations. The LTFR product required and supplied must be qualified with an �interim qualification� status on the Qualified Products List (QPL) in accordance with USDA, USFS Specification 5100-304c - Long Term Retardant, Wildland Firefighting with amendments. This notice of intent is NOT a request for proposals or quotes; however, all responsible sources, meeting the requirements including the USDA FS implemented Specification 5100-304c for Long-Term Retardant, Wildland Firefighting, may submit a quotation and technical capabilities, which, if received within 5 calendar days of publication of this notice shall be considered by the Government. All responses must be submitted to the Government primary point of contact at the contracting o?ice address shown below. If no written responses are received a?er the publication of this notice the contract will be awarded without further notice. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government.
